Instructions for Fiancée K-1 Nonimmigrant Visa Applicants

Once this office has received a petition entitling you to K-1 nonimmigrant visa classification as an alien proceeding to the United States to marry an American citizen, you need to prepare for your interview with a consular officer. Please read and follow carefully the instructions below.

FIRST: Fill out the following forms:

  • Two copies of Form DS-156 Nonimmigrant Visa Application. Only typed responses printed from the preceding link will be accepted. No handwritten resposes will be accepted.
  • Form DS-156K, Nonimmigrant Fiancée Visa Application
  • Form DS-230 Biographic Data, part I only.
  • Application fee of $100 or equivalent in BolĂ­vares (in cash per person)

All questions must be answered. If your children apply with you, one copy of Form DS-156 for each child must be completed in full, and must include a photograph.

SECOND: Obtain the following documents on this checklist, which pertain to you. Do NOT send them to this office.

  • Passport: The passport must be valid for travel to the United States and must have at least six months validity beyond the issuance date of the visa.
  • Birth Certificates: One certified copy of the birth certificate for each person named in the application is required. Birth records must be presented for all unmarried children under age 21.
  • If an official birth certificate is not obtainable, present the best possible secondary evidence, such as baptismal certificate, hospital certificate, school records, and/or a notarized affidavit from your parents.
  • Police Certificates: Each applicant aged 16 years or over is required to submit a police certificate from the police authorities of each locality of the country of the applicant's nationality or current residence where the applicant has resided for at least six months since attaining the age of sixteen. A police certificate must also be obtained from any place where the applicant has been arrested for any reason, regardless of the length of residence. Police certificates from certain countries are considered unobtainable. The consular office will advise you about any particular country.
  • Court And Prison Records: Persons convicted of a crime must obtain a certified copy of each court record and any prison record, regardless if they received an amnesty or pardon. Note: If you have been DEPORTED or have been granted VOLUNTARY DEPARTURE from the United States, you must bring the relevant documents issued by the United States Citizenship and Immigration Services (USCIS).
  • Military Records: A certified copy of any military record is required.
  • Photographs: Three (3) recent photographs are required. The photographs must be, 2 by 2 inches (50x50mm) in size, with no head covering or eye glasses, and showing a full, front-face view against a white background. The applicant must print their full name on the reverse side of each photograph.
  • Marriage Certificates: If you were married previously, obtain one certified copy of your marriage certificate(s), and one certified copy of the divorce decree or death certificate to prove the dissolution of each such prior marriage.
  • Evidence of Support: Evidence of financial support comes from the Petitioner. Usually, the petitioner completes Form I-134 Affidavit of Support, with both a job letter stating how long he/she has had his/her job and how much money he/she makes annually (submit W-2 forms and IRS 1040).
  • Medical Examination: Must be completed by an approved physician from Physicians List: Caracas Physicians or Curacao, Aruba, Winward Islands Physicians, using forms DS-2053, DS-3026, DS-3025, DS-3024 (available at Doctor's Office). Arrange for a medical examination with a physician listed on the attached information sheet. You are responsible for the cost of the examination. A medical examination is also required for each child who will accompany you. Medical examination results are only valid for six months.
  • Evidence of Relationship: You may be asked to submit proof of a valid fiancé/fiancée relationship with your petitioner. It is, therefore, useful to bring with you letters, itemized phone records, photographs, or other evidence of your relationship.
  • Translations: All documents not in English, or in the official language of the country in which the application of a visa is being made, must be accompanied by a certified English translation. We will accept English or Spanish documents without translations.

ONLY ONE COPY OF EACH DOCUMENT, EXCEPT PHOTOGRAPHS, IS REQUIRED. HOWEVER, YOU ARE ADVISED TO OBTAIN AND KEEP A DUPLICATE COPY OF EACH DOCUMENT FOR YOUR RECORDS.

All approved K-1 (Fiancee) applicants will pay DOMESA (located at the US Embassy) to send the information packet with visa and passport to an address in Venezuela. Thepacket is usually received in approximately 5-7 working days. If not, please contact DOMESA directly at (58-212) 401-4810 or 401-4811.

ADDITIONAL INFORMATION

Family Members

The unmarried, minor children of a K-1 beneficiary derive "K-2" nonimmigrant visa status from the parent so long as the children are named in the petition. A separate petition is not required if the children accompany or follow the alien fiancée within one year from the date of issuance of the K-1 visa. Thereafter, a separate immigrant visa petition is required.

Employment

At the port of entry, the alien fiancée will receive a stamp in his or her passport giving temporary permission to work pending marriage to the U.S. citizen. The marriage must take place within 90 days of admission into the United States. Following the marriage, the alien spouse must apply to USCIS to establish a record of entry for conditional permanent residence status. After two years, the alien may apply to USCIS for removal of the conditional status.
